ACCEPTANCE OF TERMS

By using this website, placing an order, or purchasing products, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions.

PRODUCTS & PROFESSIONAL USE

Black Magic Tan products are intended for their stated purpose only. Professional products are designed for use by trained spray tanning professionals.

Customers are responsible for determining the suitability of any product before purchase and use.

We recommend testing sample sizes before purchasing larger quantities of tanning solutions.

PRICING & PAYMENT

All prices displayed on this website are in U.S. Dollars (USD).

Payment must be received in full before goods are dispatched.

We reserve the right to correct any pricing errors and may cancel or refuse any order containing incorrect pricing.

ORDER ACCEPTANCE

An order confirmation email is an acknowledgment that your order has been received.

Acceptance of your order occurs when payment has been approved and the order has been processed for shipment.

Black Magic Tan reserves the right to refuse or cancel any order at our sole discretion.

SHIPPING & DELIVERY

Delivery times provided are estimates only.

Black Magic Tan is not responsible for delays caused by shipping carriers, customs processing, weather events, natural disasters, labor disputes, or other events beyond our control.

Risk of loss and title for products pass to the customer upon delivery to the shipping carrier.

RETURNS & REFUNDS

Because sample sizes are available for testing, tanning solutions cannot be returned due to color preference, performance preference, or personal dissatisfaction.

All return requests must be approved prior to return.

Approved returns may be subject to:

• A 15% restocking fee
• Deduction of original shipping charges
• Return shipping costs paid by the customer

Returned products must:

• Be unopened
• Have original tamper seals intact
• Be in new and resalable condition
• Include all original packaging

Opened tanning solutions, used equipment, or damaged products are not eligible for return unless covered by warranty.

EQUIPMENT WARRANTY

Black Magic Tan equipment is warranted against manufacturing defects.

If equipment is found to be defective within 14 days of receipt, we may repair, replace, or refund the item at our discretion.

After 14 days, warranty claims may require inspection and repair.

This warranty does not cover:

• Normal wear and tear
• Improper maintenance
• Abuse or misuse
• Unauthorized modifications
• Damage caused by incorrect cleaning procedures

Black Magic Tan’s liability under this warranty is limited to repair, replacement, or refund of the original purchase price.

LIMITATION OF LIABILITY

To the fullest extent permitted by law, Black Magic Tan shall not be liable for:

• Loss of profits
• Loss of business income
• Loss of goodwill
• Business interruption
• Indirect damages
• Consequential damages
• Incidental damages

Our total liability shall not exceed the amount paid for the product giving rise to the claim.

PRODUCT DISCLAIMER

Results from tanning products vary based on skin type, preparation, aftercare, environmental conditions, and individual application methods.

Black Magic Tan makes no guarantee regarding specific tanning results or duration of color.

INTELLECTUAL PROPERTY

All website content, including text, images, graphics, logos, product names, videos, manuals, and training materials are the property of Black Magic Tan and are protected by copyright, trademark, and intellectual property laws.

No content may be copied, reproduced, distributed, or used without prior written consent.

PRIVACY

Any dispute arising under these Terms shall be resolved exclusively in the courts located in Dallas County, Texas.

Black Magic Tan reserves the right to update, modify, or replace these Terms & Conditions at any time.
